General Terms

1. The following terms and conditions will apply between you (the client) and Nicole James Design (the designer) when you buy any of our services.
2. Your statutory rights and not affected.
3. No contract will exist between you and Nicole James Design until a confirmation email is sent after payment is received.

3. As the client you must:
   • provide your postcode, phone number, email address, and name. 
   • undertake a questionnaire (to help us determine your preferred design styles) 
   • provide us photos of your space, and provide us additional information about your room and project including budget. 
   • according to the package selected you will also have a phone call or preferably an online chat with your designer. the designer will then provide you suggestions for your space as well as a shopable list of products.
   • you confirm that all details you provide to nicole james design for services are accurate, up to date and complete.
   • by purchasing a service, you agree it will be used for your own private or domestic use only and is not for resale.
   • you must be 18 or over to use this service. if you are under 18, you may only use this service with the agreement of, and under the supervision of, a parent/guardian.
   • a video call to commence the project (or multiple projects if bought at the same time) must be booked within a year of the purchase date, otherwise you will be subject to any price increases that may have happened during that year.

4. Nicole James Design reserves the right to change prices of any service at any time. 
5. Nicole James Design does not accept liability (except as shown below) for any errors and/or omissions contained in our website and also reserves the right to change information, specifications and descriptions of any listed products and services without notice. 
6. If an error is found in the price of the services that you’ve ordered, Nicole James Design will tell you promptly. We won’t be under any obligation to fulfil an order for a service that was advertised at the incorrect price.

Payment Terms

7. Payment needs to be received before your designer commences work. 
8. Nicole James Design currently uses third parties to process payments. Our third-party payment processors accept payments through various credit and debit cards, as detailed on the payment screen. 
9. Nicole James Design reserves the right to end any agreement with you if you fail to make payment or if you break any of the terms and conditions.
10. If you have made a purchase but then wish to cancel, you must inform Nicole James Design by email within 24 hours of payment being made. you will be refunded within 7 days.
11. If you have made a purchase but then wish to change it, you must inform Nicole James Design by email (hello@nicolejamesdesign.com) within 24 hours of payment being made. After this date changes cannot be guaranteed as work on your design idea may have started.

Design Terms

12. The design Nicole James Design provides is based on the measurements given by you, the client. We cannot guarantee floorplan or 2d/3d render accuracy. They are to be used for illustration purposes only. Check all measurements before you make any purchases as we cannot be held responsible.
13. The design Nicole James Design provides is a recommendation only. We will provide details of where to buy but cannot be held responsible for changes in price, stock issues and accuracy of this information.
14. The plans will include links to third party websites and applications. you are responsible for evaluating whether you want to access or use them. We are not responsible for and do not endorse any features, content, advertising, products, or other materials on other websites or applications. You assume all risk and we disclaim all liability arising from your use of them.
15. It is up to you, the client, to implement the designs for any of our online services.
16. Retailer website images and descriptions are not always accurate. The actual colour may vary from the image or information may be missing or incorrect. 
17. Nicole James Design is not responsible for the client’s orders with retailers.
18. Delivery charges are not included on the shopping list.
19. Nicole James Design shall not have any liability to you for any delay in the delivery of services ordered or any other matters to which the delay is due to any event outside our reasonable control, including but not limited to acts of god, war, flood, fire, labour disputes, strikes, lock-outs, riots, civil commotion, malicious damage, explosion, governmental actions and other similar events.
20. The plans will not include any unrelated finishes or fixtures unless specified e.g. paint finishes for woodwork, carpet underlay, light switches.
21. Wallpaper, fabric, flooring and paint prices are per item, not an estimate of the total needed.
22. The illustrative project costs do not include the cost of any supplementary work needed to implement the plan e.g. floor fitting, decorating, electrical work.
23. Design plans will be emailed to you in around 14 days of your video call unless you’ve purchased a fast track service, in which case it will be emailed within 7 days.
24. We want you to be happy with the design first time, however if needed we can make amendments to the original design, providing it remains within the initial confirmed brief.
25. Amendments are limited to two rounds of revisions.
26. To the best extent permissible under applicable law, we disclaim any and all warranties of any kind, whether express or implied, in relation to the services. This doesn’t affect your statutory rights as a consumer, neither does it affect your contract cancellation rights.
27. Once the design plan has been sent to you the client, and the applicable support period has elapsed, the agreement between Nicole James Design and the client ends.

Publicity Terms

27. Your design plan may be displayed on social media and our website for advertising unless you expressly ask us not to.
28. If we use your design plan for marketing purposes on our website or social media, then we will also reference the retailers used, unless you expressly ask us not to.
